MyCC gains wider powers after Competition Act 2010 amendments

Amendments to the Competition Act 2010 give the Malaysia Competition Commission (MyCC) broader investigative powers, a settlement framework and a clearer court appeal process in fighting cartels, bid rigging and price-fixing. MyCC chairman Tan Sri Idrus Harun said the 34-clause amendment must stay dynamic as cartels move to digital channels, and that it closes a legal gap that let trade associations escape liability. The changes also grant MyCC mandatory powers under Section 11A to obtain data for market reviews, and allow up to a 40 per cent cut in penalties through a settlement mechanism under Section 38A.
